Brazil formalizes accession to the Budapest Treaty
On Monday, October 20, Brazil filed with the World Intellectual Property Organization (WIPO) the Instrument of Accession to the Budapest Treaty on the International Recognition of the Deposit of Microorganisms for the Purposes of Patent Procedure, its respective “Executing Regulations,” and its updates. With this step, Brazil becomes the 92nd Contracting State to the treaty.
The decision to join the treaty through Legislative Decree #174/2025 is reported in our Client Alert in June of this year. The Instrument of Accession just filed will enable Brazil to designate national institutions to act as International Depositary Authorities (IDAs).
The possibility of depositing microorganism samples with a domestic institution will reduce the costs and logistical obstacles that currently arise from having to send samples abroad. Such deposits are mandatory for compliance with sufficiency of disclosure requirements for patent applications.
