Netflix has been hit with a permanent injunction in Brazil after losing an infringement case brought by video processing software company DivX. As well as damages, which are yet to be calculated, Netflix was ordered to pay approximately US$4 million in fines for contempt of court for failing to comply with a preliminary injunction, plus legal costs. This is the first time a permanent injunction has been awarded in an ICT patent dispute in Brazil.

The win is the latest in a line of victories by DivX in asserting the same patent in Brazil. The patent, PI 0506163-6, covers a video deblocking filter used in video streaming to improve visual performance. It was first asserted by DivX against Netflix in Brazil in October 2020.

DivX, which only began patent licensing in 2019, has previously asserted the same patent against Samsung and TCL. Preliminary injunctions were awarded against Samsung (in 2021) and TCL (2022), both of which were followed by licensing agreements within a few days.
