DivX secures crucial injunction against Amazon in Brazil
Amazon.com Inc recently avoided DivX’s attempt to ban imports of smart televisions, tablets and streaming devices after the US International Trade Commission initially determined the products do not infringe four DivX patents. The patent holder will appeal.
At IAM, we profiled DivX and used Docket Navigator to examine the company’s US litigation record in district court and the ITC. DivX has settled and dismissed 10 cases in district court with two active cases against Amazon and Netflix Inc remaining. At the ITC, DivX has settled two cases against TCL Technology Group Corp and Samsung Electronics Co. The ITC case against Amazon is pending.
In the ITC case, DivX argued that Amazon’s video-processing devices, including smart TVs and its Fire line of tablets and streaming devices violated Section 337 of the Tariff Act based on infringement of US Patent Nos. 7,295,673; 8,832,297; 10,225,588; and 11,102,553, according to a notice of initial determination.
