Green patents: fast track examination extended until 2016
On April 17, 2012, the Brazilian Patent and Trademark Office (BRPTO) implemented a fast track procedure for applications covering green technologies. Since its beginning, the program has proven to be a good alternative against the BRPTO’s backlog. The average time for the BRPTO to grant a final decision is currently about 10 years. On the other hand, if the application goes through the fast track examination procedure it will be decided in about one year. The third phase of the program will end on April 16, 2015. In light of this, the BRPTO has announced that the program will enter its fourth phase, ending on April 16, 2016. To be eligible for the green fast track procedure, applications for utility model and invention must have not previously been examined and must have no more than 15 claims, of which three must be independent.
