Why Brazil is a major player on the SEP scene
Firms are adapting litigation strategy as Brazil’s unique legal system and technical expertise have made preliminary injunctions a key tool in global patent disputes
Brazil is becoming a key battleground for patent disputes as courts increasingly grant preliminary injunctions, according to firms speaking to Managing IP.
This is especially true for standard-essential patent (SEP) disputes, where there is often contention over licensing rates for technologies that are essential to how products function.
There have been several notable cases, within the last few months, of Brazilian courts granting PIs, including in favour of InterDigital against Disney, for Huawei against MediaTek, and for IP Bridge in its dispute with BYD.
