: In light of the notion of instrumentality of civil procedure, the innovations of the new Brazilian Code of Civil Procedure are better understood in the context of their use for the judicial defense of material rights. Thereby, this article will seek to analyze how the novelties regarding provisional remedies will impact intellectual property lawsuits, to which this procedural institute is considerably important.
