BRPTO establishes fast-track for patents related to the 2027 FIFA Women's World Cup

On Friday, February 27, the Brazilian Patent and Trademark Office (BRPTO) published BRPTO/PR’s Normative Ordinance #59, temporarily establishing a new category of fast-track procedure for patent applications related to the 2027 FIFA Women's World Cup. The event will be held in Brazil.

The Ordinance introduces the category of fast-track procedure called “Technology Related to the 2027 FIFA Women's World Cup,” encompassing both utility patent applications and utility model applications whose inventions and models are related to the event.

According to the Ordinance, only patent applications that meet all of the following requirements may be eligible for fast-track processing:

  1. have been filed at least 18 months prior or have a request for early publication, or, in the case of international applications filed under the PCT, have already been published by WIPO;
  2. the fee for technical examination must have been paid;
  3. not be subject to fast-track procedure;
  4. have no voluntary division or amendment to the patent application made by the applicant between the request and the decision on fast-track procedure; and
  5. must be related to the 2027 FIFA Women's World Cup.

FIFA will be responsible for submitting to the BRPTO the list of patent applications that qualify for fast-track via an institutional e-mail address to be defined by an act of the BRPTO’s Presidency. The list must include, at a minimum:

  • application number;
  • title;
  • full name of the owner;
  • indication of whether the patent application was filed by FIFA itself or by a natural or legal person acting as a partner, subsidiary, commercial partner, or contractor acting on behalf of FIFA; and
  • in cases where the applicant is not FIFA, an express statement confirming that the applicant has formal authorization from FIFA to act on its behalf.

The Ordinance takes effect on the date of its publication and will remain in force until December 31, 2027, after which the new applications for this new fast-track processing category will no longer be accepted. Once the fast-track is admitted, all administrative acts relating to the application will be prioritized, even if they occur after the expiration of the Ordinance. Prioritization will continue until the conclusion of the administrative instance or, in case of granting, until the respective patent expires.
