BRPTO publishes Ordinance on special regime for FIFA Women's World Cup 2027 trademarks

The BRPTO has published BRPTO/PR’s Normative Ordinance #58/2026, regulating the special regime established by Provisional Presidential Decree #1,335/2026 for the protection of trademarks related to the 2027 FIFA Women's World Cup. The event will be held in Brazil.

The ordinance establishes procedures for:

  • Fast-track processing of trademark applications related to the event; and

  • Simplified annotation of FIFA trademarks as well-known and highly renowned trademarks.

Eligible applications will be those listed by FIFA, including filings made by partners, subsidiaries, or entities authorized to act on behalf of FIFA. Fast-track processing will apply to all stages up to the issuance of registration.

The BRPTO will establish the “FIFA 2027 Special Regime” indicator, which will be inserted into the relevant case files for prioritization and tracking purposes.

Decisions will be rendered by officials part of a specially established Trademark Work Group, with the authority to process and decide on applications under the special regime.

The Trademark Directorate will carry out, in a simplified manner, the annotation of FIFA's well-known and highly renowned trademarks, based exclusively on the lists submitted by the entity —specific proof of these conditions is waived during the validity period of Provisional Presidential Decree #1,335/2026. The list of annotated trademarks will be published on the BRPTO’s portal.

After the exceptional period, the maintenance of these special protections shall follow the ordinary procedures provided for by law.

FIFA will be responsible for submitting to the BRPTO the list of trademark applications that qualify for fast-track via an institutional e-mail address to be defined by an act of the BRPTO’s Presidency. The list must include, at a minimum:

  • application number;

  • full name of the owners;

  • Individual Taxpayer Register (CPF) or Corporate Taxpayers Register (CNPJ) of the applicants, if domiciled in Brazil;

  • indication of whether the application was filed by FIFA itself or by a natural or legal person acting as a partner, subsidiary, commercial partner, or contractor acting on behalf of FIFA; and

  • in cases where the applicant is not FIFA, an express statement confirming that the applicant has formal authorization from the FIFA to act on its behalf.

The Ordinance also establishes direct communication with NIC.br, determining that, after completing the annotations of FIFA's well-known and highly renowned trademarks, the BRPTO must forward the list of these trademarks to NIC.br. The objective is to enable the body to spontaneously reject domain name registrations that employ expressions identical or similar to the protected trademarks, thereby reinforcing protection against misuse in the digital environment during the event period.

The ordinance takes effect on the date of its publication and will remain in force until December 31, 2027, after which the new fast-track processing category will be closed for new requests.
