BRPTO reaches the limit for PCT-PPH Requests in 2024
The Brazilian PTO (BRPTO) has announced on March 7, 2024, that the limit of 100 requests of PCT-PPH (Patent Prosecution Highway) for 2024 has been reached. In view of that, new PPH requests based on PCT positive International Preliminary Report on Patentability (IPRP) will not be accepted for the remainder of 2024. The PCT-PPH program will resume in 2025.
Ordinance #78/2022 establishes that Phase IV of the PPH Program is restricted to 100 requests based on PCT positive IPRP per year, considering all IPC sections.
