BRPTO to open Call for Contributions for Patent Statute review
On Wednesday, March 4, the BRPTO announced that it had discussed proposals for the revision of the Brazilian Patent Statute with its employees and intends to disclose those considered most relevant by managers by the end of March.
In 2026, the Brazilian Patent Statute will mark its 30th anniversary. For the Office, this milestone represents an opportunity to assess whether the Statute remains suited to Brazil’s current reality and what adjustments would be both necessary and feasible.
The BRPTO will present the consolidated proposals based on the findings of an internal Working Group, which met between 2024 and 2025. The meetings served as the basis for a report containing the proposals deemed viable, relevant, and timely.
This Call for Contributions should be seen as an opportunity for stakeholders to ensure the most adequate protection for their IP rights, for instance, those foreseen in Bill #2,056/2022:

defining the conclusion of the examination of a patent application;

adjusting the wording of Article 32 to allow amendments until the end of the examination, limited to the subject matter initially disclosed in the application; and

including in the Statute the mechanisms known as PTA and PTE – patent term adjustments and extension due to delays caused by Office itself in granting a patent or or due to the proceedings for authorizing commercialization.
