ECA Digital takes effect: key impacts
Brazil’s Children and Adolescents Statute as applied in the digital environment (ECA Digital) came into effect today, establishing new rules for the protection of children and adolescents in the digital environment. The new rules apply not only to digital products and services directed at minors, but also to those that are likely to be accessed by them.
Among the new obligations imposed on the impacted platforms, the following stand out:
-
the adoption of effective age verification mechanisms that move away from models based solely on self-declaration;
-
the adoption of proportionate measures to prevent minors from being exposed to inappropriate, unsuitable, or prohibited content;
-
the provision of reporting channels;
-
the provision of parental supervision tools;
-
the requirement to link the social media accounts of minors under the age of 16 to those of their legal guardians; and
-
the requirement for parental authorization to download apps.
The new regulatory framework will have a significant impact on companies within its scope and calls for a review of workflows, interfaces, controls, and compliance strategies.
We continue to monitor the developments related to the Digital ECA and the regulatory measures that will guide its practical implementation. Our team is available to assist companies with the interpretation of the new rules, impact assessments, and the development of compliance strategies tailored to their business model.
