Video patent owner DivX recently secured a licensing agreement with Hisense, following an HEVC SEP enforcement campaign based solely on Brazilian litigation and the recent imposition of a preliminary injunction on the defendant.

The patent owner’s recent successes in Brazil also include an interim sales ban against Amazon, a permanent injunction against Netflix and a settlement with TCL. These clearly demonstrate the advantages of enforcing SEPs in Latin America’s largest country – a strategy that has also borne fruit for Ericsson, Nokia, Philips and, most recently, ZTE.

But DivX’s dispute with Hisense also shows that Brazilian courts are increasingly taking a more nuanced approach to FRAND issues.
