Poder 360 published the article “More than 31 thousand patents can be affected by judgment at the STF.” The piece addresses the STF judgment that will occur tomorrow (April 7) due to a lawsuit filed by the Attorney General’s Office (PGR) that could limit the time of exclusivity of a patent to 20 years, regardless of lengthy delays in the patent granting process. The Sole Paragraph of Art. 40 of the Industrial Property Law (9.279 / 1996) guarantees this elasticity in which it grants ten years of exclusivity after the patent has been granted.
