National Data Protection Authority will hold a public hearing on its rule of supervision and application of administrative sanctions

On June 25, 2021, the Brazilian  National Data Protection Authority ("ANPD") announced its call to the public hearing that will discuss the draft of its rule of supervision related to the administrative sanctions provided by Art. 52 of the National Data Protection Act (“LGPD”). The hearing, which aims to discuss the normative proposal that is available for public consultation until June 28, 2021, will take place on July 8, 2021, from 10:00 AM to 12:00 PM and from 02:00 PM to  06:00 PM.

The draft proposed by the ANPD establishes the supervisory mechanisms that the Authority intends to adopt, providing actions for monitoring, guidance, prevention, and enforcement of sanctions. The Authority informed that it intends to follow the logic of responsive regulation, hoping that those regulated will be encouraged to comply with the rules and be motivated to maintain the appropriate behavior  established by the LGPD.

The session will be open to all and, during its realization, interested parties will be able to speak, making comments and suggestions regarding the theme. Those interested in collaborating with the regulatory process during the hearing must register in until 11:59 PM of July 6, 2021, through a form made available by the ANPD.
