Data privacy act (LGPD) administrative sanctions postponed to August 1st, 2021

The postponement of the sanctions was provided by Law 14.010/20.

On June 10th, President Jair Bolsonaro sanctioned Law #14.010/2020, which among other measures postpones the enforceability of the administrative sanctions provided by the Brazilian Data Privacy Act – LGPD to August 1st, 2021.

The original version of the bill intended to postpone the date of LGPD entering into force as a whole. However, after debates, the Congress agreed on postponing only the enforceability of its administrative sanctions.

The date in which LGPD will enter into force is still under debate. Last month, President Bolsonaro issued Provisional Measure # 959/20, according to which LGPD will enter into force on May 3rd, 2021. As per the Brazilian’s Federal Constitution, a provisional measure is enforced as an act but shall be approved by the Congress within a maximum period of 120 days to become definitive; otherwise, it expires.

Hence, the date for LGPD entering into force will still be analyzed by the Congress and further modifications are still possible.
