Executive Order transforms Brazilian Data Protection Authority into an autarchy
On June 14, President Jair Bolsonaro signed Executive Order # 1,124/2022, which transforms the Brazilian Data Protection Authority (ANPD) into a special autarchy. Until then, the ANPD was an organ of the Presidency of the Republic.
The transformation seeks to ensure autonomy and independency to the ANPD by applying the same framework of federal regulatory agencies. It is worth noting that the Brazilian Data Protection Act expressly provided for the need to evaluate ANPD’s conversion into an autarchy within 2 years of the date of entry into force of its regimental structure.
The Executive Order has immediate validity, but must be ratified by Congress, within a maximum of 120 days, to become definitive.
